1. Who we are, and what these terms cover

Telagate is operated by Andreas Oberdammer, Beerengasse 4, 4616 Weißkirchen an der Traun, Austria ([email protected]) — see the Imprint. These terms govern your use of the service, on the free plan and on Pro. If you are a consumer, nothing in these terms limits rights that mandatory law in your country of residence gives you.

2. The service

Telagate lets you build and publish a link page. The free plan exists without payment and without expiry, and a published free page stays online. Pro adds features — more links and sections, your own handle, animated backgrounds and others, as described on the pricing page. If Pro ends, your page stays online; Pro features are deactivated and the page falls back to what the free plan allows.

3. Your account

You need an account to build a page, you must provide a working email address, and you are responsible for what happens under your sign-in. You must be at least 14 years old to use Telagate; a paid plan additionally requires you to be of legal age or have your guardian's consent.

4. Prices and billing

Pro costs €1.69 per month or €16.9 per year, excluding VAT — the applicable tax is shown at checkout before you pay. Prices may be displayed converted to your local currency at checkout. The subscription renews automatically at the end of each billing period until you cancel.

5. Who you buy from

Paid subscriptions are sold through Stripe's merchant-of-record service. The purchase appears as "Sold through Link" and on your card statement as LINK.COM* …; Stripe issues the receipts and invoices, and collects and remits VAT or sales tax. Your contract for the service itself — this page, these terms — is with the operator named in clause 1.

6. Cancellation and refunds

You can cancel any time from your account page. Cancellation takes effect at the end of the period you have paid for — you keep Pro until then, and no further payment is taken. Stripe, as merchant of record, may additionally issue refunds within 60 days of a purchase under its own buyer protection, including where we do not respond to an escalated support case within 48 hours.

7. Right of withdrawal (consumers)

If you are a consumer in the EU, you may withdraw from a Pro purchase within 14 days of subscribing without giving reasons (§11 FAGG). By subscribing you request that the service starts immediately. If you withdraw after it has started, you owe a proportionate amount for the time already elapsed and the rest is refunded (§16 FAGG). To withdraw, write to [email protected] within the 14 days — an unambiguous statement that you withdraw is enough.

8. What may not be on your page

Your page and the destinations it links to must not contain or promote:

  • content that is illegal under EU or Austrian law;
  • pornography or sexually explicit content;
  • illegal drugs or drug paraphernalia;
  • weapons;
  • malware, phishing, scams or other fraud;
  • illegal gambling;
  • content that infringes copyright, trademarks or other rights;
  • hate speech, or National Socialist re-engagement (Verbotsgesetz);
  • impersonation of another person or organisation;
  • spam or deceptive redirects.

Violations can lead to removal of individual links, unpublishing of the page, or termination of the account (clause 12), depending on severity.

9. Your content

What you put on your page stays yours. You grant us the non-exclusive, worldwide right to host, cache, reproduce and display it, solely as needed to operate the service. You confirm that you hold the rights to everything you publish.

10. User pages, and our role as host

Pages under personal handles are created by their users. We are a hosting provider in the sense of Article 6 of the Digital Services Act: we are not liable for user content or the destinations of user links as long as we have no actual knowledge of illegality, and we act expeditiously once we obtain such knowledge. We do not, and are not obliged to, generally monitor published pages.

Anyone can report a page: use the report link shown on every public page, or write to [email protected]. A useful notice names the page URL, explains why the content is considered illegal, and includes your contact details. If we restrict or remove content on the basis of a notice, the affected user receives an explanation of the decision.

11. Automated link screening

When you save your page, the links on it are checked against third-party domain lists covering malware, phishing and scams, adult content, and gambling. A link whose domain appears on such a list is rejected at save, with a message naming the link. These lists are maintained by third parties and are best-effort: they can contain mistakes. If a legitimate link of yours is rejected, write to [email protected]. This screening happens at the moment of saving and is not ongoing monitoring of published content.

12. Termination

You can delete your account at any time; that removes your page. We may suspend or terminate an account that breaches clause 8 or these terms — with prior notice where the breach allows it, and immediately where content is severe or plainly illegal. If a paid period is cut short by a termination we caused without your breach, the unused remainder is refunded through Stripe.

13. Availability and changes to the service

We run the service with reasonable care but do not warrant uninterrupted availability. Features may change over time; the promise that a published free page stays online is the floor that does not.

14. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, and for personal injury. For slight negligence we are liable only for the breach of essential contractual duties, and not for consequential damages or lost profits. Mandatory liability rules in favour of consumers (§6 KSchG) remain unaffected.

15. Changes to these terms

We may change these terms with effect for the future. If you have a paid plan, material changes are announced by email at least 30 days before they take effect; if you object, you may terminate before they do, and the change does not bind you retroactively. Continued use after the effective date counts as acceptance only where consumer law permits it.

16. Governing law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory protections of the law of your habitual residence, and the courts competent there, remain available to you.

17. Dispute resolution

We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board. Please contact [email protected] first — most problems are solved faster that way.
